How It’s Made: Bourbon

One of the most important parts of how is bourbon made is adding Kentucky water. In fact, Kentucky water is potentially the most critical ingredient in bourbon. Kentucky water is hard, limestone-packed water that bonds nicely during the fermentation process.

Mix The Raw Ingredients

According to the American Bourbon Association, a traditional bourbon mash comprises 51% corn, wheat, rye ingredients, and water. Grab your corona corn and grain mill and add your grain into it. Run your grain mixture through the mill about three to four times, allowing the grains natural enzymes to break down into short-grain sugars.

Then, throw the grains starches into a pot of boiling water, allowing the bourbon mash to eliminate the cracked grain. Stir in the mixture until the sugary liquid called wort appears. Remove the mash from the heat as it approaches boiling point.

Where Does Bourbon Come From

Bourbon traces its heritage to immigrants who brought their whiskey-making skills to the American colonies in the 18th century. Rye was the crop of choice for them, because it was easier to establish than the traditional barley. Joel Cohen : Hello and welcome to TalksOnLaw. I’m Joel Cohen. Today we’re joined remotely by Brian Haara, attorney and author. Brian, welcome to TalksOnLaw.

Brian Haara : Thanks for having me. I’m really excited.

JC: As two lawyers talking about bourbon, why don’t we start with a legal definition. Is this actually a defined term?

BH: It’s very much defined. It’s something that has been defined since the 1800s, a little more loosely then. But then by the 1960s, it made its way into the code of federal regulations , and it’s very heavily regulated.

JC: First, why don’t we start with what has to go into it and then we can move on to restrictions.

JC: And for the aficionados out there, you mentioned the container must be charred new oak new oak meaning it’s fresh. It hasn’t been used for any barrels in the past?

BH: That’s right, no previous use. Scotch uses bourbon barrels or cherry barrels. Tequila often uses bourbon barrels. After they’ve been emptied, we basically get barrels ready for the rest of the whiskey world, but ours are first used so that way they get more interaction with the char which releases the sugars from the wood and you get a sweeter whiskey than you do with scotch for example.

What Can’t Be Added to Bourbon

JC: So that’s what must go into bourbon. What about restrictions, what can’t you include?

JC: So there’s no honey bourbon that can go under the name bourbon?

The labelling of whiskies, like all distilled spirits, follows a standard pattern that includes the products brand name, the category name , alcoholic strength, volume, name and address of the producer, and, in export markets, the local distributor. Labelling regulations are becoming increasingly complex, as certain markets require health warnings, unit alcohol labelling, maximum recommended daily intakes for men and women, drinking during pregnancy warnings, and recycling information.

Although alcoholic beverages continue to be exempt from nutrition labelling, producers should be ready to answer consumer questions. For example, the energy value of whisky is derived from its alcohol component at 91 kJ/222 kCal per 100 mL there is only a trace of carbohydrate and zero fat and protein . One unit of alcohol in the United Kingdom is 10 mL ethanol, so 28 units of alcohol in a 70-cL bottle of whisky result in 40% vol. alcoholic strength. However, elsewhere in the European Union and in Australia and New Zealand, one unit of alcohol is 10 g ethanol. The United States requires nutrition facts to be quoted in terms of American serving volumes, whereas other countries base their values in terms of metric serving volumes and per 100 mL.

Common labelling standards are obviously desirable in order to minimise the number of labels required across markets, to reduce costs, and to facilitate trade. It is imperative for producers to check local labelling regulations.

Heads, hearts and tails are monikers used to describe the three phases of the bourbon distillation process. When a bourbon mash is heated either in a pot still or a column still alcohol vapor begins to evaporate.

The first phase of this vaporizing process is known as the heads portion. With the heads are all of the unwanted vapors like methanol , acetaldehyde, and lighter esters .

The heads are not something a bourbon distiller would want to include in their final distillate. Early moonshiners either due to ignorance or desire to increase yield would sometimes include the distillate form the heads portion, and when their consumers drank it, they ended up going blind, getting very ill or even died.

Now, a little portion of the heads is fine and, in most cases, adds a bit of complexity to the distillate. It is important that a knowledgeable distiller is involved in this process to discern when enough is enough. The heads is also commonly referred to as the first cut.

After the first cut, the heads are typically thrown away, or used in a clean-burning fossil fuel converter to power other operations at a distillery. Sometimes the heads are re-distilled again until they are more suitable for consumption.

The tails portion contains less alcohol by volume and may be re-distilled much the same way as the heads to extract the cleaner and more desirable second heads.

Chocolate Malted Barley & Chocolate Malted Wheat

Chocolate malted barley is typically a special type of barley labeled two-rowed barley. Two-rowed barley was named for the fact it develops two rows of kernels on its seed head. The barley kernels are plump, straight, symmetrical, and less tapered than the usual six-rowed kernels. Also, two-rowed barley has less protein, more starch, lower enzyme content, and a slightly textured husk than six-rowed barley.

The chocolate malting is not a flavor addition, rather a process. Making The Yeast Mixture

The next step on how bourbon is made involves the creation of yeast. Every distillery has its yeast strains that they keep in cool rooms. The process begins by getting the natural yeasts from fruits and a sample solution is put on carriers. Then, they breed in ovens at 95° to 104° F .

A small amount of yeast is added to a malt extract in a glass container. The pH of the solution must range from 5.4 to 5.8 for yeast production. Then, the mixture is transferred in a dona tub to undergo fermentation.

Per the American Bourbon Association, in order to be classified as bourbon, a whiskey needs to be distilled from a mixture of grains, or mash, that’s at least 51 percent corn. The Bourbons Distilling Process
